TERMS OF USAGE
Habit Factory in Sweden AB, VAT.no. SE559198237501, Ostmästargränd 5, 120 40 Årsta, (“Habit Factory”, “we”, “us”, “our”), operates the website https://www.habitb2b.com (“the website”). Via the website, you can buy goods from Habit Factory. These general terms and conditions of purchase (the “Terms”) apply to all orders for goods that you as a consumer fill in on the website. By completing your order, you accept and agree to abide by the terms. Habit Factory reserves the right to make changes to the terms at any time. Each change is published on the website and applies from the time you have accepted the terms through a new order or ten days after Habit Factory has informed you of the changes (for example by subscription). The provisions in i.a. The Consumer Purchases Act (1990: 932) and the Act (2005: 59) on distance contracts and contracts outside business premises are applied to all purchases made by consumers via the website.
As a condition of completing an order, you accept these terms. You hereby certify and warrant that (i) you are at least eighteen (18) years of age, (ii) all information you provide is true, correct, current and complete and (iii) you have the legal authority to enter into these terms in accordance with all conditions here in, (iv) you are resident and have entered a delivery address in Sweden.
If you do not fully understand, agree and comply with these terms, or if you can not enter into a legally binding agreement, you may not access or access our website. Information that Habit Factory considers to constitute a criminal proceeding, such as an order in another person’s name, will be reported to the police. In case of suspicion of irregularities or misuse of our ordering function, Habit Factory always reserves the right to refuse a purchase.
PRICES AND FEES
All prices stated on the website are in Swedish kronor excluding VAT. Special fees may apply for shipping, invoice layout, partial payment and for unpaid packages. The total cost of your order is automatically calculated based on your choices and presented before you complete the order. All incorrectly stated prices can be corrected in connection with confirmation of your order to your e-mail address.
Payment on the website is made via one of our payment portals. Through our Payment Gateways, you can be offered payment options for card payment, invoice, partial payment or direct payment via your bank. Habit Factory does not charge an extra fee for any of the payment options. Our payment providers may charge a fee for the payment options, but state this in such a case in connection with the purchase.
When paying by card, the following debit cards are accepted: Mastercard and Visa.
When paying by invoice or installment payment, you must provide certain information about yourself that is used by the provider in order to identify you. The information you need to get identification can vary between different purchases and customers. By submitting information at checkout, you also accept our supplier terms.
When you pay by invoice or installment payment, the payment portal takes a credit report, but it does not affect your credit rating and is not visible to others who request credit information, e.g. banks. Once you have been identified, the payment portal shows which options are available to you. For payment of invoice, the payment period is 14 days.
PAYMENT WITH KLARNA
In order to be able to offer you Klarna’s payment methods, we may at the checkout share your personal information in the form of contact information and order information with Klarna, so that Klarna can assess whether you can choose the payment methods, and to adapt them for you. Your personal data that is shared is processed according to Klarna’s own data protection information.
We offer different shipping options based on order amount, size and / or your location.
Shipping note: for smaller items that can be left in the mailbox. Habit Factory reserves the right to weather conditions that make delivery to the mailbox more difficult. We also reserve the right to the dimensions of the mailbox, mailbox, safe and real estate box.
Package: for larger shipments sent to the nearest delivery point. When the package is available for download, an SMS with information about the serial number is sent to the mobile number specified when you order. When collecting a shipment, a valid ID document must be presented.
Normal delivery time is 1-3 working days from the time we have confirmed your order via email. In general, the delivery time for orders registered before 12.00 is one working day from the same working day. If the order is registered after 12.00 on a working day, the delivery time is instead calculated from the next working day. For orders registered during public holidays, the delivery time is calculated from the first working day after the end of the public holiday. In connection with your order being sent from Habit Factory, an e-mail will be sent to the specified e-mail address. If you have not received your order after three working days, contact our customer service at email@example.com and we will help you. If for any reason Habit Facotory is unable to deliver your order and has notified you, you have the option to cancel the purchase by contacting our customer service as above.
Unresolved packages / deliveries
Packages delivered to agents will be returned to Habit Factory if they have not been picked up within 14 days of the package’s arrival being notified to you. If this happens, you will be charged a fee of SEK 350 excl. VAT for costs attributable to our administration, shipping, return shipping and handling. Undissolved packages are not normally considered to be an exercise of the right of withdrawal.
Please note that Habit Factory only delivers to addresses in Sweden.
RIGHT OF WITHDRAWAL
The right of withdrawal does not apply to the purchase of oral nicotine products, as these are a perishable product with a limited shelf life. If you want to cancel your purchase, be sure to contact us immediately to make sure your order is canceled.
A product that deviates from the agreement or otherwise does not correspond to the description given by Habit Factory, you as a consumer can complain to Habit Factory. In such a case, you are welcome to contact our customer service at firstname.lastname@example.org who will send a return form to your address. The right to make a complaint only covers original defects (and not defects which, for example, are due to the product’s normal durability having passed or which have arisen due to normal wear and tear). Notification of the defect must be sent to Habit Factory within a reasonable time from the time you discovered or should have discovered the defect and always no later than 7 days from the time you received the product. Habit Factory therefore recommends that you check the product immediately upon receipt. You are responsible for the goods you return. Habit Factory therefore recommends that you pack the product so that it does not risk being damaged during transport. If possible, the product should be returned unused with undamaged original packaging (for example, you should not write, tape or put stamps on the original packaging).
In order for cases concerning transport damage to be handled as quickly as possible, we ask you to keep the product’s packaging so that it can be inspected. In order to return the product, you must also be able to prove your purchase from the website, e.g. through the order confirmation / receipt that we sent to the e-mail address you provided in connection with your order. When we have received your return, a confirmation will be sent via e-mail. Depending on the extent of the damage, e.g. return, remedial or price reduction. In the end, repurchases can occur. In the event of an approved repurchase, Habit Factory will reimburse you for the cost of the product, with the exception of costs for any return shipping due to the fact that you have not used the return slip. Habit Factory is responsible for claims for other compensation, in addition to the cost of the product, in accordance with what follows from the Consumer Purchase Act.
PRICES AND PRODUCT INFORMATION ON THE SITE
Habit Factory strives to ensure that the information on the website is always correct, but reserves the right to final sale as well as any image and writing errors on the website, such as errors in product description, incorrect price and incorrect stock status information. Habit Factory further reserves the right to correct such errors at any time and to change or update the information. All image information should be considered as illustrations and can not be guaranteed to reflect the exact appearance or nature of the product.
Habit Factory is not obligated to complete a purchase agreement or subscription if performance is hampered as a result of an event beyond our reasonable control (eg changes in legislation, government action, strike, blockade, sabotage, war, terrorism, fire, flood) , natural disaster or other extraordinary event). These circumstances release Habit Factory from the obligation to pay damages and if the circumstance has lasted longer than two months, both you and Habit Factory have the right to cancel the purchase with immediate effect.
